Mr. Armstrong commented the BoCC is ready to start work on the land use code revision process.  He gave the Commission a packet that was provided  to the BoCC outlining four potential approaches to the process.  A work session is scheduled for Wednesday the 13th to review the options and select an approach.  The BoCC will be attending the April 9th workshop meeting to discuss the path forward and what part the Planning Commission will have in that process.   

 

Item #1. – Public Hearing: Bitch Creek Ranch Subdivision Preliminary Hearing  Mark Stewart is proposing a 2 lot subdivision on approximately 80 acres. The residential lots will meet the zoning requirements and will each be approximately 39.9 acres. The proposed subdivision is located north and west of the Felt Townsite.

Mr. Chase reviewed the preliminary application for a two lot subdivision on approximately 80 acres.  An NP Evaluation and a Wildlife Resource Analysis were conducted by the applicant.  DEQ reviewed the NP Evaluation and concurred with the findings and there is a letter from EIPH verifying the site can accommodate the septic systems proposed for the site.  Idaho Fish & Game did not respond to the request to review the Wildlife Resource Analysis.  There were no concerns or comments from the Fire Marshal or the Public Works Director. 

 

Mr. Patrick Gilroy, representing the application, did not do a formal presentation but was available for questions.

 

PUBLIC COMMENT:

 

There was no public comment.

 

COMMISSION DELIBERATION:

 

Ms. Johnston asked if all outstanding issues mentioned in the staff report were resolved prior to this hearing.  Mr. Chase commented a Land Management Plan was submitted and he felt it adequately addressed the wildlife concerns cited in the staff report.

 

MOTION:  Having concluded that the Criteria for Approval of a Subdivision Preliminary Plat found in Title 9-3-2(C-8) can be satisfied and having found that the proposal is generally consistent with the goals and policies of the 2012-2030 Teton County Comprehensive Plan,  I move to RECOMMEND APPROVAL of the Preliminary Plat for Bitch Creek Ranch Subdivision as described in the application materials submitted January 24, 2019 and as supplemented with additional applicant information attached to this staff report.
